Article 3 – Scope of Application
These GTC exclusively govern sales made through the Website.
They apply to all products offered for sale, including:

lifestyle clothing;

sports equipment;
-
limited-edition products;

In the event of any conflict between a previous version and the version in force at the time the order is placed, only the latter shall apply.
Article 4 – Products
The essential characteristics of the products are described on the product pages available on the Website.
Photographs, visuals, videos and illustrations are provided for information purposes only and have no contractual value.
Due to textile manufacturing processes, technical constraints related to printing, screen calibration or dye lots, slight differences in colour, pattern placement or finishing may exist between the photographs and the product delivered, without this constituting a lack of conformity.
Size guides are provided for information purposes only. Customers are responsible for checking the available information before placing an order.
Article 5 – Product Availability
Product offers remain valid as long as they are visible on the Website and subject to stock availability.
Despite all checks carried out, exceptional unavailability may occur after an order has been validated.
In such circumstances, Coureur Du Dimanche will inform the customer as soon as possible.
The customer may then choose:
-
a refund of the amounts paid;
-
store credit, where this option is offered;
-
replacement with an equivalent product, subject to the customer's agreement.
The refund will be made using the payment method used for the order as soon as possible.
For certain sporting events or limited collections, products may be offered for pre-order. Estimated manufacturing and shipping times will then be stated on the relevant product page. These times are provided for information purposes only and may change depending on production, supply or transportation constraints. In the event of a significant change, the customer will be informed as soon as possible.
Article 6 – Prices
Product prices are stated in euros (€), including all taxes (VAT included), excluding delivery charges, unless otherwise indicated on the Website.
Delivery charges are specified to the customer before the final validation of the order and are added to the total amount payable.
Coureur Du Dimanche reserves the right to change its prices at any time. However, products are invoiced based on the prices applicable at the time the customer validates the order.
In the event of an obvious pricing error resulting from a technical malfunction, computer error or clerical error, Coureur Du Dimanche reserves the right to cancel the order after informing the customer and to issue a full refund of any amounts that may have been paid.
Any promotions, discounts or promotional codes are valid only during their stated validity period and subject to the conditions specified when they are issued. Unless otherwise stated, they may not be combined with one another or converted into cash.
Article 7 – Orders
The customer selects the products they wish to purchase and adds them to their shopping cart.
Before finally validating the order, the customer is responsible for checking the accuracy of the information provided, including:
-
the products selected;
-
sizes, colours and quantities;
-
delivery address;
-
billing address;
-
contact details.
The customer is solely responsible for the information entered when placing the order. Coureur Du Dimanche shall not be held liable for any consequences resulting from inaccurate or incomplete information provided by the customer, particularly in the event of an incorrect address resulting in a delay, inability to deliver or additional charges.
Any validated order constitutes acceptance of the prices, products ordered and these General Terms and Conditions of Sale.
Article 8 – Formation of the Contract
The sales contract shall be deemed concluded when the customer:
-
validates the contents of their shopping cart;
-
accepts these General Terms and Conditions of Sale;
-
makes payment for their order.
Following validation, a confirmation email will be sent to the email address provided by the customer when placing the order.
Coureur Du Dimanche reserves the right to refuse or cancel any order for a legitimate reason, including in the event of:
-
a previous dispute with the customer;
-
total or partial non-payment of a previous order;
-
suspected fraud;
-
abusive use of promotional offers;
-
manifestly incorrect or inconsistent information.
Article 9 – Payment
Orders may be paid exclusively using the payment solutions offered on the Website at the time the order is placed.
Depending on the services activated on the store, payment methods may include:
-
Bank Card (CB);
-
Visa;
-
Mastercard;
-
Apple Pay;
-
Google Pay;
-
Shop Pay;
-
PayPal.
Payments are secured using SSL/TLS encryption technologies and are processed by specialised payment service providers, including Shopify Payments when offered on the Website.
As part of Shopify Payments, transactions are processed by Stripe Payments Europe Ltd or any other entity designated by Shopify to provide payment services in the relevant country.
At no time does Coureur Du Dimanche have access to the customer's confidential banking details.
The order amount is charged upon validation of the order, unless otherwise stated on the product page or in connection with a specific payment method.
The invoice is made available to the customer electronically and may be provided upon request.
Article 10 – Fraud Prevention
In order to ensure transaction security, Coureur Du Dimanche reserves the right to carry out any appropriate verification concerning orders placed on the Website.
Additional checks may be carried out in the event of suspected fraud, identity theft, fraudulent use of a payment method or any other transaction presenting a particular risk.
In this context, Coureur Du Dimanche may request from the customer any document required to verify their identity or the legitimacy of the order.
If a satisfactory response is not received within a reasonable period, the order may be suspended or cancelled, without such decision giving rise to any liability on the part of Coureur Du Dimanche.
In the event of cancellation, any amounts received will be refunded using the payment method used for the order.
Article 11 – Pre-orders
Certain products offered on the Website may be sold on a pre-order basis. This information is clearly indicated on the relevant product page.
The estimated shipping or availability date is provided for information purposes only. This date may change due to manufacturing, supply, transportation or logistical constraints, or circumstances beyond the control of Coureur Du Dimanche.
In the event of a significant change to the announced timeframe, the customer will be informed by email as soon as possible.
Pre-order products are manufactured or sourced specifically to meet demand. When an order contains both products that are immediately available and pre-order products, Coureur Du Dimanche may, depending on the circumstances, make a single shipment or several shipments. The applicable arrangements are specified at the time of ordering or on the product page.
Article 12 – Delivery
Products are delivered to the address provided by the customer when placing the order.
The delivery methods offered are those displayed when the order is validated. They may include home delivery, delivery to a collection point or any other delivery method offered on the Website.
Products are shipped by the carriers offered on the Website at the time the order is placed.
As of the date of publication of these General Terms and Conditions of Sale, the delivery methods offered include:
-
Colissimo with tracking, delivered to the customer's home with or without signature;
-
Colissimo Point Retrait, delivered to a relay point or partner collection point.
The customer selects their preferred delivery method when validating the order. The applicable delivery times and charges are specified before final confirmation of the order.
A tracking number is provided to the customer once the order has been shipped, allowing them to track the delivery of their parcel.
Delivery charges are stated before final validation of the order.
Delivery times provided are estimates only. They take into account preparation times and the delivery times announced by the carrier.
A delivery delay shall not automatically entitle the customer to cancel the order, receive a refund of delivery charges or receive compensation, except in cases provided for by applicable law.
In the event of loss, damage or delivery difficulties attributable to the carrier, Coureur Du Dimanche will assist the customer with the necessary procedures in order to find an appropriate solution.
Article 13 – Event Collection and Click & Collect
For certain products or events, Coureur Du Dimanche may offer free collection at a trade show, race village, sporting event or any other collection point indicated at the time of ordering.
Collection arrangements (date, opening hours, location and any documents that may be required) are specified on the product page or in the order confirmation email.
The customer agrees to collect their order during the stated period.
If the order is not collected within the announced timeframe, Coureur Du Dimanche will contact the customer to agree on an appropriate solution. Additional reshipping charges may be requested if the order needs to be shipped after the event.
Article 14 – Receipt of Products
The customer is responsible for checking the apparent condition of the products upon receipt.
In the event of an irregularity (damaged parcel, missing product, damaged product or non-conforming product), the customer is encouraged to make any appropriate reservations with the carrier where possible and to contact Coureur Du Dimanche as soon as possible, enclosing any useful supporting documents, including photographs.
Any claim must be submitted within a reasonable period in order to allow the matter to be investigated.
Coureur Du Dimanche undertakes to examine each request diligently and to offer, depending on the circumstances, a repair, replacement, refund or any other solution compliant with applicable legal provisions.
Article 15 – Transfer of Risk
In accordance with the provisions of the French Consumer Code, the risks of loss or damage to the products are transferred to the customer when the customer, or a third party designated by them other than the carrier, physically takes possession of the products.
When the customer chooses a carrier other than the one offered by Coureur Du Dimanche, the transfer of risk occurs as soon as the parcel is handed over to the carrier chosen by the customer, under the conditions provided for by applicable regulations.
The transfer of risk is without prejudice to the transfer of ownership, which occurs after full payment of the order price.
Article 16 – Right of Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumer customers have a period of fourteen (14) calendar days from receipt of the products in which to exercise their right of withdrawal, without having to provide any reason or bear any costs other than those provided for by law.
To exercise this right, the customer must notify their decision before the expiry of the withdrawal period, by any means that allows proof of the notification to be retained, including by email sent to sav@coureurdudimanche.com or via the contact form available on the Website.
The products must be returned within a maximum period of fourteen (14) days following notification of the decision to withdraw.
Direct return costs remain the responsibility of the customer, unless otherwise stated on the Website.
Article 17 – Exceptions to the Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal may not be exercised in particular for:
-
products made according to the customer's specifications;
-
personalised products (printing, marking, embroidery, personalised name or graphic customisation);
-
products specially made as part of a specific order where resale is impossible or manifestly compromised.
These exclusions are clearly stated on the relevant product pages where applicable.
Article 18 – Return Conditions
Returned products must be:
-
new;
-
unworn;
-
unwashed;
-
unused;
-
complete;
-
accompanied by any applicable accessories;
-
returned in their original packaging or packaging providing equivalent protection.
The customer is responsible for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.
Any return that does not comply with these conditions may result in a reduction of the refund or refusal of a refund where the product can no longer be resold in its original condition.
Before making any return, the customer is encouraged to contact customer service in order to facilitate the processing of their request.
Article 19 – Refunds
Where the right of withdrawal is validly exercised, Coureur Du Dimanche shall refund the amounts owed to the customer in accordance with applicable legal provisions.
The refund shall be made within a maximum period of fourteen (14) days from receipt of the withdrawal decision. However, Coureur Du Dimanche may defer the refund until the products have actually been recovered or until the customer has provided proof of shipment, whichever occurs first.
The refund shall be made using the same payment method as that used for the original order, unless the customer expressly agrees to another refund method.
When the customer chooses to use a return label provided by Coureur Du Dimanche, a flat-rate return fee of €7.50 including VAT shall apply. This amount will be directly deducted from the refund.
The customer remains free to return the products using the carrier of their choice. In this case, return costs remain entirely the customer's responsibility and no flat-rate fee will be deducted by Coureur Du Dimanche.
In the event of a partial return of an order, only the amount corresponding to the products actually returned and eligible for a refund will be refunded, subject to compliance with these General Terms and Conditions of Sale.
Article 21 – Liability
Coureur Du Dimanche shall use all reasonable efforts to ensure the accuracy of the information published on the Website and the availability of the products offered.
